3. Scope

The present Conditions of Participation regulate participation in the event set out in section 1. By registering for the event, the participant accepts these conditions of participation and his or her exclusive application.

The participant grants the organizer the irrevocable, royalty-free, worldwide rights and licenses to the entry in order to use, rethink, evaluate, test or otherwise analyze the entry in connection with the Hackathon and to use the entry for advertising purposes.

The Participant acknowledges that the Promoter or others may have developed or will develop similar or identical Entries and that they waive any claims arising out of such similarities.
The participant does not have the right to use or display the logos or brands of the sponsors outside the event mentioned in section 1. The same applies to the technologies or IP addresses provided.

4. Code of Conduct

For the duration of the event, the organiser, its legal representatives and the parties involved in fulfilling its obligations are entitled to issue instructions to the participant. All instructions which the personnel carrying out the event must issue must be complied with in order to avoid risks.

The participant is obliged to refrain from all actions that could impair or endanger other participants, agents of the organizer or other persons. The participant should behave with the highest discipline in the course of the event.

The Participant agrees that photographs, film footage and interviews taken in connection with participation in the Event may be disseminated and published in radio, television, print and online media, books, photomechanical reproductions (films, video cassettes, etc.) without restriction as to the duration or geographical location of such use. The participant is not entitled to any remuneration.

5. Conditions of Participation

Persons who are 18 years of age or older can participate.

To register for the event, the participant must enter his/her first and last name, birthday and education/course/occupation.

The data of the participants will be collected, stored and used by ICNAP exclusively for the execution of the event within the framework of electronic data processing. The data will not be passed on to third parties.
(1) The conditions of participation must be accepted prior to registration for the event.
(2) The competition begins on May 5, 2023 and ends on May 7, 2023.
(3) The team size is limited to a maximum of five persons. If a participant does not belong to a team before the event, the organization will assign the participant to a team before the event.
(4) Participation in the event is free of charge.

6. Property Rights / IP

By his or her participation in the Hackathon, the participant confirms that he or she is the author of the submitted idea and that no third party rights exist with regard to the idea(s). Should third parties nevertheless assert a claim for infringement of their rights and this infringement is caused by intentional or grossly negligent behaviour on the part of the participant, the participant shall be liable for all damages which are subject to ICNAP or affiliated companies.

7. Participants

The event is planned for a number of sixty (60) external participants. If more than 60 participants register, the organizer will decide. Only participants who have entered a valid e-mail address will be considered for participation. The participant is responsible for ensuring that the e-mail address provided is correct. The participant will be notified by e-mail after the slots for the event have been allocated.
In the course of the event, ICNAP may make or photograph film recordings, and it may also record statements, interviews with the undersigned and such as on audio and/or video media. ICNAP is entitled to use the above-mentioned services. In this respect, ICNAP expressly has the right - regardless of time and place - to archive, edit, reproduce, distribute, distribute and publish the footage, photographs and other recordings in sound or image form. The right to reproduce the aforementioned objects in public includes the right to illustrate and present them, the right to transmit them, the right to reproduce them in the form of sound or images and the right to reproduce radio and television programmes. The aforementioned exploitation rights are granted irrespective of the type of transmission or reproduction; they include in particular the right to exploitation by electronic media, in particular the Internet.

8. Refusal of Registration

The ICNAP can refuse registration for the event without having to state the cause. In principle there is no claim to participation in the event. ICNAP also reserves the right to exclude the participant from the already admitted event at any time. This applies in particular in cases where the rules of the game are violated or where technical means or other manipulative aids are used. In this case ICNAP is entitled to revoke the prices and / or demand that they be returned. This also applies if the participant does not provide truthful information when providing the personal data.

9. Final Provision

If  any provision of these participation conditions should be or become invalid, this shall not affect the legal validity of the remaining provisions. This valid provision shall be deemed agreed instead of the invalid provision, which in its economic effect is as close as possible to what the parties intended.

German law applies. The place of performance shall be the registered office of Fraunhofer IPT. The exclusive place of jurisdiction for all disputes arising from this agreement, insofar as such an agreement on the place of jurisdiction is admissible, shall be the registered office of Fraunhofer IPT.
